29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 dBA: a) On or about May 5, 2022, the employer did not implement a continuing effective hearing conservation program for an employee ( AFE 1), who was exposed to noise at an eight-hour time weighted average of 86.5 dBA with a severity approximately 101.8% times greater than the action level of 85 dBA during the 483 minute sampling period conducted on May 5, 2022. b) On or about May 5, 2022, the employer did not implement a continuing effective hearing conservation program for an employee ( AFE 2), who was exposed to noise at an eight-hour time weighted average of 86.1 dBA with a severity approximately 101.3% times greater than the action level of 85 dBA during the 505 minute sampling period conducted on May 5, 2022. c) On or about May 6, 2022, the employer did not implement a continuing effective hearing conservation program for an employee ( Rebinner), who was exposed to noise at an eight-hour time weighted average of 85.6 dBA with a severity approximately 100.7% times greater than the action level of 85 dBA during the 514 minute sampling period conducted on May 6, 2022.
