At the construction site, the employer did not ensure that employees using a nail gun for roofing activities were provided eye protection.  Employees were exposed to being struck by flying objects.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  At a residential construction site, employees performing roofing activities without fall protection were exposed to a fall hazard at a height of over 13 feet to the ground below.   Ignacio Sierra was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1505743, Citation Number 1, Item number 1, and was affirmed as a final order on January 22, 2021, with respect to a workplace located at 706 Marigold Dr. Midlothian, Texas 76065.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  At the residential construction site, employees accessing the roof on a metal ladder with side rails that did not extend at least 3 feet above the edge of the roof were potentially exposed to fall hazard greater than 13 feet.  Ignacio Sierra was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1505743, Citation Number 1, Item number 1, and was affirmed as a final order on January 22, 2021, with respect to a workplace located at 706 Marigold Dr. Midlothian, Texas 76065.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.   At the residential construction site, the employer did not ensure employees using ladders to access/egress roofs to install roofing material were trained to recognize and avoid slip and fall hazards related to ladders.
