29 CFR 1910.25(b)(2):29 CFR 1910.25(b)(2): The employer did not ensure that vertical clearance above any stair tread to any overhead obstruction is at least 6 feet, 8 inches (203 cm), as measured from the leading edge of the tread: (a) Facility, Stairs Leading To/From Basement: On or about March 28, 2022, the employer did not ensure the vertical clearance above the stair tread to the bulkhead was at least 6 feet, 8 inches. The actual clearance from the closest stair tread to the bottom of the bulkhead in the stairway was 67 1/2 inches (5 feet 7 1/2 inches). Employees use this stairway throughout the day as they assist residents of the home.

29 CFR 1910.145(c)(2)(i): Caution signs were not used to warn against potential hazards or to caution against unsafe practices: (a) Facility, Stairs Leading To/From Basement: On or about March 28, 2022, caution signs were not used to warn employees of the low clearance from the stairway ceiling bulkhead. The ceiling bulkhead was 5 feet 7 1/2 inches above the closest stair tread to the set of stairs to the basement.
