29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d).  At a worksite located at or near 7577 Meadow Ridge Road in Egg Harbor, Wisconsin; the employer did not ensure that each employee operating the Skytrak 8042 all-terrain forklift was competent to operate the truck safely, as demonstrated by the successful completion of training and evaluation.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  At a worksite located at or near 7577 Meadow Ridge Road in Egg Harbor, Wisconsin; the employer did not provide for frequent and regular inspections of the worksite and equipment used where a competent person adequately inspected the work areas to address and eliminate hazards while employees were engaged in residential construction activities.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about April 19, 2022, at a worksite located at or near 7577 Meadow Ridge Road in Egg Harbor, Wisconsin; employees engaged in sheathing the lower level of a new 2-story duplex were not protected from falling to the ground, exposing the employees to a fall hazard of approximately 10 feet 10 inches.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

On or about March 17, 2022, at a worksite located at or near 7577 Meadow Ridge Road in Egg Harbor, Wisconsin; the employer did not make provisions for prompt medical attention in case of serious injury prior to commencing the building of a new, 2-story duplex. An employee descending an extension ladder from the second floor of the two-story duplex was struck on the head by a prefabricated wall and did not receive prompt medical attention.

29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, shall be available at the worksite to render first aid.  On or about March 17, 2022, at a worksite located at or near 7577 Meadow Ridge Road in Egg Harbor, Wisconsin; the employer did not make available a person who had a valid certificate in first-aid training that could be verified by documentary evidence for the treatment of injured employees. On or about April 19, 2022, at a worksite located at or near 7577 Meadow Ridge Road in Egg Harbor, Wisconsin; an employee securing trusses for the front door overhang on a new, two-story duplex was using the rung nearest the top step and the support rung on the backside to straddle the top step of a Keller 8-foot, self-supporting stepladder, exposing the employee to fall hazards from the top of the ladder.
