29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) On or about February 7, 2022, Elevate Care Niles, LLC did not provide a medical evaluation to determine a temporary workers ability to use a N95 respirator prior to caring for a COVID- 19 positive patient in 5 North.   Elevate Care Niles, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1510454, citation number 1, item number 1b and was affirmed as a final order on July 9, 2021, with respect to a workplace located at 8333 W. Golf Road in Niles, IL 60714.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting respirators were not fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  a) On or about February 7, 2022, Elevate Care Niles, LLC did not ensure that a temporary employee was fit tested prior to requiring them to use a N95 respirator when caring for COVID-19 positive patients in 5 North.  b) On or about  February 25, 2022, Elevate Care Niles, LLC did not ensure that an employee was fit tested annually prior to requiring them to use a N95 respirator when caring for COVID-positive patients in 5 North.  Elevate Care Niles, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1510454, citation number 1, item number 1c and was affirmed as a final order on July 9, 2021, with respect to a workplace located at 8333 W. Golf Road in Niles, IL 60714.

29 CFR  1904.41(a)(2): 29 CFR 1904.41(a)(2) Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.  a) On March 31, 2022, Elevate Care Niles, LLC failed to electronically submit information from their OSHA Form 300A or equivalent, for  during calendar year 2021, by March 2, 2022. The establishment employed 220 employees and was classified 623110 during calendar year 2021.
