29 CFR  1910.134(a)(2): 29 CFR 1910.134(a)(2): The employer did not provide appropriate respirators when necessary to protect employee health:   a) On or about January 10, 2022, Anthology of Grayslake, did not ensure that Nurses and CNAs who were providing care to COVID-19 suspect and positive residents at the facility, were provided and required to use a N95 respirators. Employees were provided and they used the ZHONG JIAN LE KN95 masks.   In accordance with 29 CFR 1903.19 (d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstration that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Employees used ZHONG JIAN LE KN95 masks. 29 CFR 1904.41(a)(2): 29 CFR 1904.41(a)(2): The establishment had 20 or more but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified as an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  a) On March 31, 2022, Anthology of Grayslake, LLC failed to electronically submit information from their 2021 OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee by March 2, 2022. The establishment employed 48 employees and was classified with NAICS 623112 during calendar year 2021.  In accordance with 29 CFR 1903.19 (c), abatement certification only is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
