General-duty citation text
29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): Miller Wall Company at 8211 Southpark Cir. Littleton, CO 80120: On or before 4/1/22 the controlling and correcting employer did not protect employees from injury in that a retaining wall was being erected against the side of a hill with a vertical cut wall measuring approximately 15 feet tall. Employees were working within 15 feet of the face of this wall, raking gravel and laying CMU block. The vertical cut wall showed signs of fissuring and sloughing and was not sloped, benched, or shored in accordance with this standard. The vertical cut wall had been cut more than 90 days prior to the date of the inspection and storm systems had effected the integrity of the vertical earthen wall. These conditions exposed employees to struck-by, falling object, and cave-in hazards. Abatement Note: Abatement certification is required for this item, see enclosed "Certification of Corrective Actions Worksheet."
