OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to moving rail cars' struck-by and caught-in between hazards:  On or about March 25, 2022, the employer did not ensure that rail car ground men assigned to uncouple loaded and unloaded rail cars were protected from moving rail cars struck-by and/or caught in-between hazards likely to result in serious injury. Employees were present on the tracks to perform work when locomotives with attached railcars were remotely operated by employees other than those uncoupling loaded and unloaded rail cars.
