The employee worked from edge that was not protected with a guardrail or travel restraint system. b) Fill area # 2 mixer: On April 6, 2021 and times prior, an employee dumped materials inside a bakers perkin dough mixer. The employee worked from edge of mixer that was not protected by a guardrail or travel restraint system.

29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Warehouse: On April 6, 2021 and times prior, the employees voluntarily use respirators when tasked to produce batches using raw materials such as aluminum trihydrate and ground high calcium carbonate limestone. Employer did not establish and implement those elements of a written program that included ensuring employees are medically able to use, how to clean, store and maintain respirators so that its use does not present a health hazard to the employee.
