OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards while operating automotive hydraulic lifts:   a. On or about April 7, 2022, in the repair shop, the employer did not ensure that employees were safe from crushing and struck-by hazards in that the following lifts were noted with deficiencies: (1) air/hydraulic center mounted drive on lift , did not have the locking mechanism locked into place while the lift was raised and in use. (2) air/hydraulic center mounted drive on lift , did not have a load capacity placard mounted. (3) Auto lifts were not inspected periodically by a qualified inspector at least annually to ensure that they were properly used, maintained and functioning.   Among other methods, one feasible and acceptable means of abatement would be to:  1. Follow the requirements contained within ANSI/ALI ALOIM:2008 to ensure that lift operators conduct daily lift inspections and remove from service, any lifts not meeting the requirements as set forth in that standard. 2. Ensure that operators use all applicable safety features provided on the automotive lifts, which includes utilizing locking mechanisms.  3. Institute a training program for the employees on the safe use and operation of automotive lifts and their safety features.  4. Ensure that all automotive lifts are inspected by a qualified lift inspector at least annually.

29 CFR  1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  a.  On or about April 7, 2022, in the service shop South wall, the employer did not ensure that all egress routes were unobstructed by material which interferes in emergency evacuations.
