29 CFR  1926.651(b)(3): When excavation operations approached the estimated location of underground installations, the exact location of the installations was not determined by safe and acceptable means:  (a) ARCO/Murray National Construction Company, Inc., as a controlling employer, failed to ensure that employees of Finley LLC., excavation subcontractor, were protected from fire and explosion hazards associated with underground utility installations. This violation was recently observed on or about April 5, 2022 at 4700 E Evans Ave in Denver, CO. The company did not use safe and acceptable means to determine the exact location of a gas line when digging a shallow trench near the line with a mini excavator. The excavator bucket contacted the line during digging, which could result in a sudden release of natural gas.
