29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a). Worksite located at 4877 Osage Parkway Ave., Osage Beach, Missouri- Employees were exposed to fall hazards while working on the exterior platforms which were not protected by adequate guardrails. The host employer failed to install midrails on and therefore exposed all employees on the jobsite to fall hazards. (b). Worksite located at 4877 Osage Parkway Ave., Osage Beach, Missouri- The employer staged his mixing pumper next to a wall where there was a fall hazard in which employees were not protected from falling by the use of any means of fall protection.

29 CFR 1926.28(a):The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: Worksite located at 4877 Osage Parkway Ave., Osage Beach, Missouri- The employer failed to ensure employees were wearing personal protective equipment required while mixing the gypcrete mixture which recommends safety glasses or goggles, Impervious protective clothing and gloves recommended, and A NIOSH approved dust mask or filtering face piece.
