29 CFR 1910.134(g)(2)(iii): The employer did not repair or replace the respirator before allowing an employee to return to the work area when the employee detected vapor or gas breakthrough, changes in breathing resistance, or leakage of the facepiece: (a) On or about April 5, 2022 in the MR3 Unit at the Covestro chemical manufacturing facility in Baytown, Texas, worker was exposed to chemical fumes when the employer did not repair or replace the respirator before allowing its employee to return to the work area after the worker had experienced an unexpected disconnection of the respirator from a damaged airline which caused a change in breathing resistance of the respirator and caused the worker to remove the respirator while in the work area where a hazardous atmosphere was present.

29 CFR 1910.134(g)(2)(ii)(B):The employer did not ensure that employees left the respirator use area when employees detected vapor or gas breakthrough, changes in breathing resistance, or leakage of the facepiece: (a) On or about April 5, 2022 in the MR3 Unit of the Covestro chemical manufacturing complex in Baytown, Texas, employee was exposed to toxic fume hazards when the employee remained in the work area after a problem with the airline stopped airflow to the facepiece of his respirator causing difficulty breathing.
