29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  On 4/8/2022 and times prior to, employees of Brown Construction Company were installing storm water drainage pipes in a trench measuring approximately 80 feet long by five feet wide by eight feet deep.  Brown Construction Company did not train employees to recognize and avoid engulfment hazards associated with working in an excavation.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   On 4/8/2022, employees of Brown Construction Company were installing storm water drainage pipes in a trench measuring approximately 80 feet long by five feet wide by eight feet deep at a jobsite located at 9999 Old Highway 60 in Dudley, Missouri.  Brown Construction Company did not ensure that employees implemented a safe means of egress while working in the trench.  The nearest safe means of egress for employees working in the trench was located approximately 70 feet away.  Employees were exposed to struck-by and engulfment hazards.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  On 4/8/2022, employees of Brown Construction Company were installing storm water drainage pipes in a trench measuring approximately 80 feet long by five feet wide by eight feet deep at a jobsite located at 9999 Old Highway 60 in Dudley, Missouri.   The employer did not ensure that a daily inspection was performed by a competent person on excavations/trenches when employee exposure was anticipated.  Employees were working in the trench area exposed to engulfment hazards.

29 CFR 1926.652(a)(1):  Each employee in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On 4/8/2022, employees of Brown Construction Company were installing storm water drainage pipes in a trench measuring approximately 80 feet long by five feet wide by eight feet deep at a jobsite located at 9999 Old Highway 60 in Dudley, Missouri.  The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from engulfment hazards.
