29 CFR  1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)  On or about April 9, 2022, and at times prior, employees were exposed to amputation and caught-in hazards while working around and stepping over an unguarded chain drive conveyor.  An employee of Voss Road Tire & Auto dba Evergreen Car Wash & Detail, sustained severe foot injuries while working in the pre-wash tunnel when his left foot slipped through a 2.5" opening in the floor and was caught in the unguarded chain drive conveyor that pulls vehicles through the carwash.    Or in the alternative:  29 CFR  1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment was protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment was covered or guarded to eliminate the hazard:  (a)  On or about April 9, 2022, and at times prior, employees were exposed to amputation and caught-in hazards while working around and stepping over an unguarded chain drive conveyor.  An employee of Voss Road Tire & Auto dba Evergreen Car Wash & Detail, sustained severe foot injuries while working in the pre-wash tunnel when his left foot slipped through a 2.5" opening in the floor and was caught in the unguarded chain drive conveyor that pulls vehicles through the carwash.

29 CFR  1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)  On or about April 9, 2022, and at times prior, employees were exposed to eye injury while working with and around water hoses spraying at 600 psi without eye protection in place.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:  (a)  On or about April 9, 2022,  the employer,  Voss Road Tire & Auto dba Evergreen Car Wash & Detail, 29002 Crossroads Lane, Evergreen, CO 80439, did not report a work-related in-patient hospitalization to OSHA within 24 hours. An employee sustained injuries while working in the pre-wash bay when his left foot was caught in the chain drive conveyor that pulls vehicles through the carwash.  The employee was hospitalized on April 9, 2022, and the employer did not report the hospitalization.
