29 CFR 1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: On or about April 12, 2022, no evidence was provided that shows employees had forklift training prior to the incident that pinned an employee between a forklift and a car. The employer provided certificate of training permits that were issued after the incident, which did not include the injured employee.

29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: Warehouse Shipping Area: On or about April 11, 2022, employees were exposed to struck by and caught between hazards when the parking brake on a Toyota forklift, model number 7FBEU18, serial number 24438, failed to hold on an approximate 5 degree decline, causing the forklift to roll and pin an employee between it and a vehicle.
