29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Worksite - On or about April 20, 2022, the employer did not provide a medical evaluation to each employee who was required to wear a tight fitting respirator, including but not limited to: users of 3M 6800 Full Face air purifying respirators and Moldex filtering facepiece respirators.  Employees wore these respirators while grinding and blasting.

29 CFR 1904.41(a)(2): Employer with establishment having 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and establishment is classified in an industry listed in appendix A to subpart E of this part, did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee:  a) Located at Optimum Window Manufacturing Corp. at 28 Canal St. Ellenville, NY 12428: On or about April 26, 2022, the employer failed to electronically submit information from their OSHA Form 300A or equivalent for calendar year 2021 by March 2, 2022.  The establishment employed approximately 45 employees during calendar year 2021 and is classified 332321 during calendar year 2021.  Note: Employer must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the forms.
