29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Shenandoah Manor Nursing Center: An employee was required to wear a respirator for protection from residents with suspected and/or confirmed COVID-19 illness, and the employer did not provide this employee with a respirator medical evaluation, on or about April 13, 2022. ABATEMENT CERTIFICATION REQUIRED ABATEMENT NOTE: In accordance with 1910.134(e)(6), when determining an employee's ability to use a respirator, the employer shall obtain a written recommendation regarding the employee's ability to use the respirator from the physician or other licensed health care professional (PLHCP) that performed the medical evaluation or examination.
