29 CFR 1910.28(a)(1): The employer did not provide protection for each employee exposed to fall and falling object hazards. The employer did not ensure that all fall protection and falling object protection required by this section meet the criteria in � 1910.29, except that personal fall protection systems required by this section meet the criteria of � 1910.140. (a) Kroger, Parkersburg: On April 14, 2022, employees were tracing a leak on top of a cooler approximately 10 feet above the lower working surface without the use of a fall protection system.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. (a) Multiple Worksites: On April 14, 2022 and times prior, employees perform HVAC and similar work from roofs and atop cooler systems at heights above four feet and have not been trained on the associated fall hazards and use of fall protection systems.
