On or about April 13, 2022, at a work-site located at 220 Drott Street, Schofield, WI: the employer failed to initiate and implement an accident prevention program which includes frequent and regular inspections of their job sites to ensure employees were not exposed to fall hazards while performing from elevated surfaces.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about April 13, 2022, at a work-site located at 220 Drott Street, Schofield, WI: An employee was exposed to a fall hazard of 11 feet while walking along an unprotected side of an elevated wall section on the south side of the building to retrieve window trim.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e): On or about April 13, 2022, at a work-site located at 220 Drott Street, Schofield, WI: Two employees were exposed to a 30 feet fall hazard while working in a JLG 660SJ aerial lift without the use of a full body harness with a lanyard attached to the manufacturer supplied boom or basket anchor point of the lift. Martinez General Construction, LLC. was previously cited for a violation of this Occupational Safety and Health Standard 1926.453(b)(2)(v) which was contained in OSHA Inspection Number 1504571, Citation 1, Item 2 and was affirmed as a Final Order on 02/04/2021 with respect to a worksite located at 190 E. 27th Street, North Kansas City, MO.
