29 CFR 1926.652(a)(1): Employees in excavations were not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) sloping and benching or (c) support/shield/protective systems of this section: On or about 4/18/2022, the employer failed to provide cave-in protection such as sloping, benching, or use of a trench box when employees were working in an excavation five (5) feet, five (5) inches in depth, approximately two (2) feet wide, approximately thirty (30) feet in length, and comprised of material consistent with that of a Type C soil.
