29 CFR 1910.28(b)(13)(ii): The employer did not ensure that when work is performed at least 6 feet (1.6 m) but less than 15 feet (4.6 m) from the roof edge, each employee is protected from falling by using a guardrail system, safety net system, travel restraint system, or personal fall arrest system. The employer may use a designated area when performing work that is both infrequent and temporary.  [In the alternative, 1926.501(b)(1 ): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.]  On or about April 20, 2022, during construction activities including but not limited electrical installation on the roof of an ACME store located at 1709 OH-59, Kent, OH 44240, the employer did not ensure employees were protected from a greater than 25-foot fall by ensuring a fall protection system/device was used during an electrical installation.
