29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Nilson Andrade De Costa, at the jobsite located at 5846 Wynnewood Dr. Lot: TV18, Grove City, Ohio 43123: On and/or preceding March 20, 2022, the employer failed to provide employees a fall protection training program for the recognition of fall hazards and procedures to be followed to minimize these hazards. Employees without fall protection training were engaged in framing activities, thereby exposed to fall hazards greater than 20 feet.

29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) Nilson Andrade De Costa, at the jobsite located at 5846 Wynnewood Dr. Lot: TV18, Grove City, Ohio 43123: On and/or preceding March 20, 2022, employees were utilizing scaffolding while engaged in siding activities to a residential single-family house. The employer failed to initiate and maintain fall protection program to address the identification or prevention of fall hazards.  Nilson Andrade De Costa was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(1), which was contained in OSHA inspection number 1568660, citation number 1, item number 1 and was affirmed as a final order on February 25, 2022, with respect to a workplace located at Lot 274 at Ellington Village, Granville, Ohio 43023.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Nilson Andrade De Costa, at the jobsite located at 5846 Wynnewood Dr. Lot: TV18, Grove City, Ohio 43123: On and/or preceding March 20, 2022, the employer failed to ensure employees were utilizing safety glasses while operating a pneumatic nail gun, thereby exposing employees to struck-by hazards to the eyes and face.  The  Nilson Andrade De Costa was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1568660, citation number 1, item number 3 and was affirmed as a final order on February 25, 2022, with respect to a workplace located at Lot 274 at Ellington Village, Granville, Ohio 43023.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Nilson Andrade De Costa, at the jobsite located at 5846 Wynnewood Dr. Lot: TV18, Grove City, Ohio 43123: On and/or preceding March 20, 2022, the employer did not ensure that fall protection was utilized by employees engaged in framing activities to a residential single-family house, thereby exposing employees to fall hazards greater than 20 feet.  The  Nilson Andrade De Costa was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1568660, citation number 1, item number 4 and was affirmed as a final order on February 25, 2022, with respect to a workplace located at Lot 274 at Ellington Village, Granville, Ohio 43023.
