29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a) Hills View Homes at 554 Solomon Court, Rapid City, SD 57702: On or about and at times prior to April 22, 2022, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were conducting framing operations on a single-family residence without the use of a fall protection system. This condition exposed subcontractor employees to fall hazards of greater than six feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a)Hills View Homes at 554 Solomon Court, Rapid City, SD 57702: On or about and at times prior to April 22, 2022, the controlling employer did not ensure that subcontracted employees were protected from falls while conducting framing operations during the construction of a single-family residential home. This condition exposed the subcontractor employees to fall hazards greater than six feet.
