29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck. On or about April 25, 2022, and at times prior thereto, the employer did not ensure that each employee had been trained, evaluated, and certified in accordance with 29 CFR 1910.178(l) prior to operating forklifts exposing employees to struck-by hazards.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. On or about April 25, 2022, and at times prior thereto, the employer did not provide a training program with hazard recognition and avoidance training where part of the job is to be exposed to fall hazards at heights over six (6) feet to the ground below.
