On the bridge at the construction site, located at State Road 60 and US 27, Lake Wales, FL: On or about 04/25/2022 and at times prior, the employer exposed employees to struck by hazards, in that the crane operator on site was not certified to operate the cranes on site.

29 CFR 1926.1431(a):The use of equipment to hoist employees was not prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the projects structural design or worksite conditions. On the bridge at the construction site, located at State Road 60 and US 27, Lake Wales, FL: On or about 04/25/2022 and at times prior, the employer exposed employees to fall hazards, in that the bid-well was lifted by a crane while an employee was still on the bid-well.
