29 CFR 1910.134(f)(2):The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. 500 COVID-19 Hall, Room 507: On or about December 29, 2021 to January 9, 2022, the employer did not ensure that an employee using a tight fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model, or make) is used, and at least annually thereafter. The employer required employees to wear respirators while providing care to suspected and confirmed positive COVID-19 residents. Employees were required to wear Makrite Sekura N95 respirator during the performance of tasks, such as feeding, bathing, maintaining continence, inserting and maintaining IV's, conducting assessments, skin treatments and other close patient interactions. Abatement documentation is required for this item in accordance to with the requirements of 29 CFR 1903.13(d).

29 CFR 1910.134(e)(6)(i)(C): The employer did not obtain a statement that the physician or other licensed health care professional (PLHCP) had provided the employee with a copy of the PLHCP's written recommendation: 500 COVID-19 Hall, Room 507: On or about December 29 ,2021 to January 9, 2022, the employer did not obtain a statement that the physician or other licensed health care professional had provided the employee with a copy of the PLHCP's written recommendation. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents. Employees perform tasks such as feeding, bathing, dressing, maintaining continence, conducting assessments, and skin and comfort treatments while using tight-fitting facepiece respirators.
