29 CFR 1926.403(b)(1): Examination. The employer shall ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined on the basis of the following considerations: a) Martin Vargas Framing, at the jobsite located at 4169 Portwatch, Lot #SM253, Canal Winchester, Oh 43110: On and/or preceding March 27, 2022, the employer failed to ensure electrical equipment were free from recognized hazards. Employees utilized electrical extension cords with damaged insulation to supply electrical power to tools, thereby exposing the employees to electrical hazards.

29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) Martin Vargas Framing, at the jobsite located at 4169 Portwatch, Lot #SM253, Canal Winchester, Oh 43110: On and/or preceding March 27, 2022, the employer the employer failed to provide employees a fall protection training program for the recognition of fall hazards and procedures to be followed to minimize these hazards. Employees without fall protection training were engaged in framing activities, thereby exposed to fall hazards greater than 10 feet.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) Martin Vargas Framing, at the jobsite located at 4169 Portwatch, Lot #SM253, Canal Winchester, Oh 43110: On and/or preceding March 27, 2022, the employer did not ensure portable ladders that were used for access to an upper landing surface were extended at least 3 feet (.9m) above the upper landing surface. Employees utilized an extension ladder to access to an upper landing surface, the side rails did not extended beyond the upper landing surface. The following condition exposed employees to falls greater than 10 feet.

While engaged in residential roofing construction activities, employees while used an 8 foot step ladder as a non-self-supporting ladder to access an upper landing surface, thereby exposing employees to fall hazards greater than 10 feet.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Martin Vargas Framing, at the jobsite located at 4169 Portwatch, Lot #SM253, Canal Winchester, Oh 43110: On and/or preceding March 27, 2022, the employer did not ensure that fall protection was utilized by employees engaged in framing activities to a residential single-family house, thereby exposing employees to fall hazards greater than 10 feet. The Martin Vargas Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501.(b)(13), which was contained in OSHA inspection number 1478475, citation number 1, item number 1b and was affirmed as a final order on July 7, 2020, with respect to a workplace located at 3412 Lauren Fields Dr., Groveport, Ohio 43215.
