29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Workplace, 26-28 Van Reipen Avenue, Jersey City, NJ  The employer did not implement the engineering controls identified on Table 1 for employees directed to demolish and repair concrete stairways with electric chipping hammers.    Violation occurred on or about April 12, 2022 and continuing thereafter.

Violation occurred on or about April 12, 2022 and continuing thereafter.

29 CFR  1910.134(f)(2) as referenced in 29 CFR 1926.103: Employee(s) using a tight-fitting facepiece respirator were not fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:    a) Workplace, 26-28 Van Reipen Avenue, Jersey City, NJ  The employer did not ensure employees required to wear half mask respirators during the demolition and removal of excess concrete on stairways using Bosch chipping hammers were provided fit tests.   The employees were exposed to the hazard of airborne respirable crystalline silica.  Violation occurred on or about April 12, 2022 and continuing thereafter.
