29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about April 28, 2022, at this location, employees engaged in sling manufacturing were exposed to hazardous materials, such as but not limited to, degreasers, cleaning chemicals, and lubricants. The employer had not developed and implemented a program which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, and is consistent with the Globally Harmonized System (29 CFR 191200(a)(1)).  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills; 3. The hazards of the materials contained in piping that is not labeled, and; 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.

29 CFR  1910.1200(h)(2):The employer did not provide employees with effective information on hazardous chemicals in their work area at the time of their initial assignment and whenever a new chemical hazard the employees have not previously been trained about was introduced into their work area. Employees were not informed of the following: the requirements of this section; any operations in their work area where hazardous chemicals are present; and, the location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets as required by this section.  (a) On or about April 28, 2022, the employer did not provide adequate training to employees that utilize hazardous chemicals with information on the requirements of a Hazard Communication program, the chemicals utilized at the facility, a list of the hazardous materials present at  the facility, and information on Safety Data Sheets (SDS) and how to access the SDS.
