29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following: (A) Covers; (B) Guardrail systems; (C) Travel restraint systems; or Personal fall arrest systems. a) Nestle USA, Inc., located at 61 Jerseyville Avenue, Freehold NJ 07728 - Cold room : Employees were not protected from fall hazards of approximately 12 feet to the concrete ground below when they were working near the edge of an opened hinge grating trap door located in the cold room. An employee sustained injuries, including a punctured lung and broken ribs after falling through the grate while hoisting a machine distributor through the hole, occurred on or about 4/15/2022.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Nestle USA, Inc., located at 61 Jerseyville Avenue, Freehold NJ 07728 - Cold Room: The employer did not guard the conveyor belt rolls on the Belt HTR Line 1 / MCC-AO-A-9-10 line to protect the machine operators from in-going nip point hazards. Observed on 04/28/2022.
