29 CFR 1910.119(h)(3)(i): The contract employer did not assure that each contract employee was trained in the work practices necessary to safely perform his/her job. On or about April 23, 2022, in the ROSE unit at Valero Meraux refinery located in Meraux, LA, workers were exposed to fire and explosion hazard, when the contract employer did not ensure that the contract employees have knowledge and training of Valero policy and procedures that were being used for line break/opening process piping.

The contract employer did not prepare a record which contained the identity of the contract employee, the date of training, and the means used to verify that the employee understood the training. 29 CFR 1910.119(h)(3)(ii):The contract employer shall assure that each contract employee is instructed in the known potential fire, explosion, or toxic release hazards related to his/her job and the process, and the applicable provisions of the emergency action plan. On or about April 23, 2022, in ROSE unit at Valero Meraux refinery located in Meraux, LA, workers were exposed to fire and explosion hazard, when the contract employer did not inform its employees that the 8-inch vertical pipe contained uncontrolled amount of flammable hydrocarbons at greater than atmospheric pressure.
