29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a- 150 Waverly Avenue, Mount Laurel NJ: A  company worker was exposed to struck by hazards and head injuries when working around and near an excavator that was placing buckets full of soil, removed from a trench, onto spoil piles while moving this bucket overhead while near this unprotected worker.  This worker was not instructed nor did they receive any instruction from the company regarding the recognition and elimination of hazards when working and walking near and around  operating excavation equipment .  Noted on or about 04/27/22.  b- 150 Waverly Avenue, Mount Laurel NJ: A company worker was exposed to slip, fall, and crushing hazards when working and walking at the unprotected edges of an open trench.  This worker was not instructed nor did they receive any instruction from the company regarding the recognition and elimination of hazards when working and walking next to unprotected edges of an open trench.  Noted on or about 04/27/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a- 150 Waverly Avenue, Mount Laurel NJ: A  company worker was exposed to head injuries when working around and near operating excavating equipment without the use of a hard hat.  This worker was working around and near an excavator that was placing buckets full of soil, removed from a trench, onto spoil piles while moving this bucket overhead while near this unprotected worker.   Noted on or about 04/27/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a- 150 Waverly Avenue, Mount Laurel NJ: On or about 04/27/22, a company worker was exposed to struck by hazards and head injuries when working around and near an excavator that was placing buckets full of soil, removed from a trench, onto spoil piles while moving this bucket overhead while near this unprotected worker.
