Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards while working at or near dust collection systems collecting titanium fines which were not designed, installed, and located to prevent or minimize exposure in the event of a deflagration, explosion, or other uncontrolled fire event:  a) In the Chip Wash Area, on or about April 27, 2022 - The three AQE4000 Overhead Cartridge Systems used to collect titanium fines from dryers were not grounded independently of the electrical grounding system.  b) In the Chip Wash Area, on or about April 27, 2022 - The three AQE4000 Overhead Cartridge Systems used to collect titanium fines from dryers were dry-type cartridge filter media air-material separators (AMS).   c) In the Chip Wash Area, on or about April 27, 2022 - The three AQE4000 Overhead Cartridge Systems used to collect titanium fines from dryers were not provided with isolation devices to prevent deflagration propagation between the connected equipment.  d) In the Chip Wash Area, on or about April 27, 2022 - The three AQE4000 Overhead Cartridge Systems used to collect titanium fines from dryers recycled exhaust air into the building.  e) In the Chip Wash Area, on or about April 27, 2022 - The three AQE4000 Overhead Cartridge Systems used to collect titanium fines from dryers were located inside the building.  f) In the Chip Wash Area, on or about April 27, 2022 - The three AQE4000 Overhead Cartridge System used to collect titanium fines from dryers did not have a suppression system with control panels that had a standard battery backup of no less than 24 hours.

29 CFR  1910.178(c)(2)(vii): Approved power-operated industrial trucks designated as DY, EE, or EX were not used in atmospheres in which combustible dust will not normally be in suspension in the air or will not be likely to be thrown into suspension by the normal operation of equipment or apparatus in quantities sufficient to produce explosive or ignitable mixtures but where deposits or accumulations of such dust may be ignited by arcs or sparks originating in the truck:  a) In the Chip Wash Area, on or about April 27, 2022 - A Yale Model GLC050VXNEAE083 fork truck designated as LP was used in a Class II, Division 2 location exposing employees to dust explosion, deflagration, and other fire hazards.
