29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Dakota Directional, L.L.C., at the intersection of 6th street and US Highway 212, Watertown, SD 57476: On or about and at times prior to April 28, 2022, the employer did not ensure that each employee conducting work in an excavation was protected from cave-in, in that the excavation was greater than feet in depth and lacked an adequate protective system, such as appropriate sloping, benching, or shield system. Employees accessed the trench excavation to hand dig around a 10 inch gas main and install a de-watering pump. This condition exposed employees to cave-in and struck-by hazards when performing work in an excavation greater than five feet in depth.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a)Dakota Directional, L.L.C., at the intersection of 6th street and US Highway 212, Watertown, SD 57476: On or about and at times prior to April 28, 2022, the competent person failed to remove employees from potential harm when multiple hazardous conditions were evident and in plain sight including sluffing vertical walls, water entering the excavation and poor soil conditions. Employees, were working in an un-protected trench, weakened by water intrusion with unprotected sides and edges. These conditions were exposing employees to struck-by, crushed-by hazards.
