29 CFR  1903.19(c)(1):The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  a)  On or about August 18, 2022 the employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation below had been abated:  29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Lagos Construction LLC is failing to ensure that its employees are protected from fall hazards while performing framing work at heights greater than 6 feet above a lower level. This practice led to employees being unprotected from fall hazards on April 30, 2022 when framing a single-family residential building without fall protection at heights greater than 16 feet at 6522 Kenzie Circle, Castle Pines, CO 80108.  Abatement Note: Pursuant to 29 CFR 1903.19, the employer must submit documents that demonstrate the steps it is taking to protect employees and ensure compliance, including an explanation of how these steps protect its employees from fall hazards during framing activities and work at heights.
