29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about April 30, 2022, the employer did not ensure that its employees were protected from falls while working at heights greater than 6 feet. Employees of Ivan Sarmiento were exposed to fall hazards in excess of 25 feet while engaged in roofing activities on the roof of a residential building with no fall protection in place. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: (a) On or about April 30, 2022, the employer did not ensure that portable ladders used to access upper landing surfaces extend at least 3 feet above the upper landing surface to which the ladders were used to gain access. Workers were exposed to fall hazards greater than 12 feet while using a ladder to access the roof of a residential building. Ladder did not extend at least 3 ft above the landing platform and was not secured to the roof.
