29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Capital C Masonry located at 3032 Avalon Road, Upper Arlington, OH 43221:  On and preceding May 2, 2022, the employer did not ensure that employees working in an area where there was possible danger of head injury from falling or flying objects were protected by protective helmets.   A masonry crew was working on a two tier scaffold with tools staged on the scaffolding approximately 14 feet above ground level tossing materials to the ground. Employees were walking/working in the area directly beneath the scaffold without head protection thereby exposing employees to struck-by hazards.

29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.   a) Capital C Masonry located at 3032 Avalon Road, Upper Arlington, OH 43221:  On and preceding May 2, 2022, the employer did not install planking on scaffolding so that the space between adjacent units and the space between the platform and the uprights was no more than 1 inch.  A masonry crew was working on a two tier scaffold approximately 14 feet above ground level with gaps in the planking up to 15 inches thereby exposing employees to fall hazards.

29 CFR  1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates and mud sills or other adequate firm foundation:  a) Capital C Masonry located at 3032 Avalon Road, Upper Arlington, OH 43221:  On and preceding May 2, 2022, the employer did use appropriate base plates and mud sills to support scaffold poles with an adequate, firm foundation. A masonry crew was working on a two tier scaffold approximately 14 feet above ground level with several base plates and mud sills out of place or missing thereby exposing employees to fall and struck-by hazards in the event of a collapse of the scaffolding.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   a) Capital C Masonry located at 3032 Avalon Road, Upper Arlington, OH 43221:  On and preceding May 2, 2022, the employer did not ensure that an adequate means of access/egress was provided for employees working on a scaffolding platform at heights up to 14 feet.  Employees were observed utilizing crossbraces for access to the upper tier of the scaffolding thereby exposing them to falls up to 14 feet.

29 CFR  1926.451(g)(4)(i):Guardrail systems were not installed along all open sides and ends of platforms.  a) Capital C Masonry located at 3032 Avalon Road, Upper Arlington, OH 43221:  On and preceding May 2, 2022, the employer did not install guardrail systems along all open sides and ends of scaffolding platforms at heights up to 14 feet.  A scaffolding platform that was in use for masonry work on a multi-story residential home had sections throughout the second tier of the platform that did not have guardrails installed thereby exposing employees working on scaffolding to falls up to 14 feet.

29 CFR  1926.451(h)(2):Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section:  1926.451(h)(2)(i): The area below the scaffold to which objects can fall shall be barricaded, and employees shall not be permitted to enter the hazard area; or  1926.451(h)(2)(ii):  A toeboard shall be erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below, except on float (ship) scaffolds where an edging of 3/4 x 1 1/2 inch (2 x 4 cm) wood or equivalent may be used in lieu of toeboards  a) Capital C Masonry located at 3032 Avalon Road, Upper Arlington, OH 43221:  On and preceding May 2, 2022, the employer did not ensure employees working below a scaffold were protected from fallings tools, materials, or equipment.  A masonry crew was working on a two tier scaffold approximately 14 feet above ground level tossing materials to the ground.  The area beneath the sections where work was being performed was not barricaded nor were there toeboards in place to prevent tools and materials from falling to the ground thereby exposing employees to struck-by hazards.
