29 CFR  1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely.  On or about April 18, 2022, and at times prior thereto, employees were working on a flat roof without a determination by the employer of the strength and structural integrity of the surface, exposing the employees to the hazard of falling up to approximately 30-feet to the concrete floor below.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.   On or about April 18, 2022, and at times prior thereto, employees were working on a flat roof without the use of a guardrail system, personal fall arrest system, or other acceptable form of fall protection, exposing the employees to the hazard of falling up to approximately 30-feet to the concrete floor below.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On April 18, 2022, at approximately 2:41pm, an employee suffered an injury that resulted in hospitalization. The hospitalization was not reported within 24-hours to the local Area Office of the Occupational Safety and Health Administration. The incident was first reported to the OSHA Houston North Office on April 25, 2022 and then reported to the OSHA Austin Office on April 26, 2022.
