29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) Power pole movement job for the newly constructed indoor shooting range - just south of 16765 Coastal Highway (Delaware Route 1), in Lewes, DE 19958 - right most lane of the north bound lanes: On or about 5/4/2022, employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed flagging operations and other operations to facilitate site preparation work for power pole movement without the use of a properly communicated traffic control plan and internal traffic control plan.

29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards: a) Power pole movement job for the newly constructed indoor shooting range - just south of 16765 Coastal Highway (Delaware Route 1), in Lewes, DE 19958 - right most lane of the north bound lanes: On or about 5/4/2022, employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed site preparation work for the movement of power poles, when signs were not posted and flaggers were used to assist line trucks in positioning their vehicles from one parking lot to another effectively closing the right lane road temporarily in the northerly direction.
