29 CFR 1926.100(a): Employees were not protected by protective helmets while working in the areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  A)	On or about 05/05/2022, at the site of 80-79 Tryon Place. Jamaica Estates, NY  Employees working on the ground/lower level of scaffolds were in danger of head injury from falling objects such as, but not limited to tools and materials from other employees who worked above. Protective helmets were not worn.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)   A.           On or about 05/05/2022, at the site of 80-79 Tryon Place. Jamaica Estates, NY    Employees working on the fabricated frame scaffolds were exposed to the hazard of falling approximately 15 ft. to the stairway surface. The working platforms were installed with only three scaffold planks.

29 CFR 1926.451(e)(1): Where scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used for access:  A.           On or about 05/05/2022, scaffolds at 80-79 Tryon Place. Jamaica Estates, NY    Employees working on fabricated scaffolds approximately 15 ft. while installing stone to the front face of the 2-story house were exposed to the hazard of falls. The employees climbed/descended  the frame of scaffolds to gain access.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs g(1)(i) through g(1)(vi) of this section, each employee working on a scaffold more than 10 ft. above a lower level was not protected from falling to that lower level by the use of guardrails or personal fall arrest systems:  A.           On or about 05/05/22, scaffolds at 80-79 Tryon Place. Jamaica Estates, NY    Employees working from tubular welded frame scaffolds were exposed to a fall hazard of approximately 15 ft. while installing stone to face of 2-story house.  REPEAT VIOLATION: GIM Construction Inc. was previously cited for a violation of this Occupational Safety and Health Standard, its equivalent, or essentially similar standard 29 CFR 1926. 451(g)(1)(vii), which was contained in OSHA Inspection Number 1446643, Citation Number 01, Item Number 002, issued on 01/23/2020.
