29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   a) Brian Egan Construction, Inc. located at 1678 Cardiff Road, UPPER ARLINGTON, OH 43221:  On and preceding May 4, 2022, the employer did not ensure the employees installing framing pieces using pneumatic nails wore eye protection thereby exposing them to struck-by hazards to the eyes.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Brian Egan Construction, Inc. located at 1678 Cardiff Road, UPPER ARLINGTON, OH 43221:  On and preceding May 4, 2022,  the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing framing pieces on a throughout a residential new addition construction site at heights up to 11 feet. The employees were not utilizing any form of fall protection which exposed them to falls up to 11 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) Brian Egan Construction, Inc. located at 1678 Cardiff Road, UPPER ARLINGTON, OH 43221:  On and preceding May 4, 2022, the employer did not ensure the ladder being used for access to the second floor of a two story residential home addition extended at least three feet beyond the upper landing  and/or was secured with a grasping device.  The following condition exposed employees to falls up to 10 feet.
