29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator or annually refitted:  a) COVID Unit - 3 South: On or about 5/6/22 and thereafter, the employer provided and required a Registered Nurse to wear an N-95 respirator. The employer did not provide an initial fit test to the affected employee to protect against the SARS-CoV-2 virus. The employee provided direct care to confirmed positive COVID-19 patients including, but not limited to taking performing finger sticks, insulin injections, etc.   b) COVID Unit - 3 South: On or about 5/6/22 and thereafter, the employer provided and required behavioral health technicians (BHTS) to wear an N-95 respirator. The employer did not provide an initial fit test prior to initial use of the respirator to protect against the SARS-CoV-2 virus. The employees wore provided direct care to confirmed positive COVID-19 patients including, but not limited to checking vital signs, providing constant observation, dining room monitoring, etc.   In addition to abatement certification, the employer is required to submit abatement documentation for this item. Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   a) COVID Unit 3 South: On or about 5/6/22 and thereafter, the employer provided and continued to require a Behavior Health Technician to wear a Honeywell DC365 N-95 respirator after the employee failed the fit test due to facial hair that came between the sealing surface of the facepiece.   The employee to continue wear this same brand/model N-95 filtering facepiece respirators while providing direct care to confirmed positive COVID-19 patients.  In addition to abatement certification, the employer is required to submit abatement documentation for this item.  Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19.
