29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:   (a) On or about April 28, 2022, and at times prior, at or near Milton R. Young Station Minnkota Power Cooperative 3401 24th Street SW, Center, ND, prior to allowing workers to enter the Plenum to clean out Fly Ash, the employer failed to conduct an assessment to determine the existence and/or levels of respiratory hazards which would necessitate the use of respiratory protection. Employees were exposed to inhalation hazards during the removal of Fly Ash.
