29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    a) Jobsite, at/near 3436 Broadhead Road, Monaca, PA: On or about May 9, 2022, during water line tie in activities, the employer did not ensure that a safe means of egress existed in an excavation determined to be up to approximately 6 feet, 3/10ths of a foot in depth.

29 CFR  1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:   a) Jobsite, at/near 3436 Broadhead Road, Monaca, PA: On or about May 9, 2022, during water line tie in activities, the employer did not ensure that tools and equipment including, but not limited to, a saw, a level and a shovel, were either kept 2 feet from the edge of the excavation or were controlled in some manner by a retaining device to prevent them from falling or rolling into the excavation.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions and the inspection was not conducted by the competent person prior to the start of work, as needed throughout the shift or after every rainstorm or other hazard increasing occurrence:   a) Jobsite, at/near 3436 Broadhead Road, Monaca, PA: On or about May 9, 2022, during water line tie in activities, the employer did not ensure that a competent person performed an appropriate inspection of the excavation to ensure employee safety and compliance with regulatory requirements. Deficiencies noted during the inspection included, but were not limited to, failure to use appropriate cave in protection in an excavation determined to range between approximately 5 feet and 6 feet, 3/10th's of a foot in depth.
