29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   A) Roof of the structure: Employees engaged in roofing activities on a 6 on 12 pitched roof were observed exposed to fall hazards of approximately 18ft to the asphalt below as (1) employee was not using any means of fall protection and a second employee had donned a personal fall arrest harness which was not secured. Condition observed on or about May 9th, 2022.  Moises Sagastume Construction Inc was previously cited for serious violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.501(b)(13): which was contained in OSHA Inspection Number 1544887, Citation # 1, Item # 3, issued on 08/17/2021 with respect to a workplace located at 25 Old Jerome, Yonkers NY 10704. This citation became a final order on 09/14/2021.  NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  A) Exterior, Back of the house: Employees were exposed to fall hazards of approximately 23 feet while using an extension ladder that was not extended at least 3 feet over the landing that they were accessing, on or about April 10th, 2021.  Moises Sagastume Construction Inc was previously cited for serious violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.1053(b)(1): which was contained in OSHA Inspection Number 1544887, Citation # 1, Item # 4, issued on 08/17/2021 with respect to a workplace located at 25 Old Jerome, Yonkers NY 10704. This citation became a final order on 09/14/2021.  NOTE: Because abatement of this violation is already documented in the inspection case  file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
