29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. a) On May 10, 2022, Lexington Health Care Center of Lake Zurich, Inc. dba Avantara Lake Zurich. did not ensure that a written respiratory protection program with worksite-specific procedures that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix) was established for employees required to wear respiratory protection. Employees were required to use N95 respirators including Makrite Sekura TC84A-7638 N95 respirators, when providing care to COVID-19 positive residents. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
