29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  a) Worksite was located at 19 Adams Street, Lakewood, NJ 08701 Workers were exposed to caught in and struck by hazards as they were not instructed in how to recognize soil types and trench hazards prior to opening a trench approximately 5 foot, seven inches deep in Type C soil with sheer walls and no cave in protection. Violation was observed on or about May 10, 2022.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) Worksite was located at 19 Adams Street, Lakewood, NJ 08701 Workers were exposed to caught in hazards as they were working to install a drainage pipe in a trench that was approximately 40 feet long and more than 4 feet deep with no ladders in the trench to provide for access and egress. Violation occurred on or about May 10, 2022

29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) Worksite was located at 19 Adams Street, Lakewood, NJ 08701 Workers were exposed to caught in and struck by hazards while they worked in a trench that was approximately 5 feet, 7 inches deep with approximately 3 feet of spoils set on the leading edge of the excavation with no set backs. Violation was observed on or about May 10, 2022

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) Work site was located at 19 Adams Street, Lakewood, NJ 08701 Workers were exposed to caught in and struck by hazards as they were working  to install 15 inch drainage pipe in a trench that was 5 feet, 7 inches deep in Type C soil with no shoring to protect them from cave ins. Violation was observed on or about May 10, 2022.
