29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On or about May 12, 2022, three employees from MLK Construction LLC were observed working on the rooftop of a split-level residential building located at 2006 Lafayette Ave., St. Louis MO. They were removing/renovating the wall panel of the building. They were not utilizing guardrail system, safety net system, personal fall arrest system nor warning line systems. The three employees were observed on a 4:12 sloped roof, approximately 35 feet above the ground without utilizing fall protection.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension was possible because of the ladder's length, the ladder was not secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about May 12, 2022, three employees from MLK Construction LLC were observed working on the rooftop of a split level residential building located at 2006 Lafayette Ave. in St. Louis MO. They were removing/renovating wall panel of the building wherein workers had to use a 2 extension ladder to access the roof. The ladder was not extended three feet beyond the landing surface or edge of the roof.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support). On or about May 12, 2022, three employees from MLK Construction LLC were observed working on the rooftop of a split level residential building located at 2006 Lafayette Ave. in St. Louis MO. They were removing/renovating wall panel of the building wherein workers had to use a 2 extension ladder to access the roof. The ladder did not meet the required angle wherein the horizontal distance from the top to the foot of the ladder was approximately 1:4 ratio of the working length of the ladder.
