29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Santos Martinez Roofing, LLC. On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not provide head protection to employees tasked with working near where overhead roofing work was being performed 25 ft. above. An employee tasked with picking up discarded shingles on the ground was exposed to falling equipment and building materials striking him in the head.

29 CFR  1926.403(b)(1):Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  a) Santos Martinez Roofing, LLC On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not inspect flexible cording, used to power a circular saw to ensure it was free of damage and in safe operating condition prior to utilizing for cutting decking during roofing activities on a steep slope roof. Employees using flexible cording in this condition employees were exposed to electrical shock.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Santos Martinez Roofing, LLC On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not ensure employees engaged in roofing activities upon an 8/12 steep slope roof were protected from falls. Four roofers were exposed to falls up to 25ft to the ground below.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Santos Martinez Roofing, LLC. On or about May 13, 2022, at the site location of 5937 Oak Point Rd. Lorain, OH: The employer did not ensure the side rails of the aluminum extension ladder used on site to access the roof were extended at least three feet above the landing surface. Employees using the ladder in this condition to access the roof level were exposed to falls from height of 10 ft.
